By visiting our Website, requesting a service quote, or entering into a service agreement with us, you (“Client”, “User”, or “you”) agree to these Terms in their entirety. If you do not agree, please discontinue use of the Website immediately.

2. Our Services
BRIGHTN8 provides AI-powered automation solutions to businesses. Our current service offerings include, but are not limited to:
AI Lead Generation – Automated discovery, qualification, and delivery of business leads.
WhatsApp Business Automation – Intelligent chatbot flows and automated customer communication via WhatsApp API.
AI Voice Receptionists – 24/7 automated voice handling systems for inbound calls.
Invoice Automation – End-to-end document processing and workflow automation for billing.
Custom n8n Workflows – Bespoke automation workflows tailored to specific business operations.
Website & CRM Integration – Seamless connection of your tools, platforms, and databases.
All services are delivered under individual Statements of Work (SOW) or Service Agreements, which form part of these Terms. In the event of conflict, the signed SOW shall take precedence.

3. Use of Website
You agree to use our Website only for lawful purposes. You must not:
Use the Website in any way that violates applicable local, national, or international law or regulation.
Transmit any unsolicited or unauthorised advertising or promotional material (“spam”).
Attempt to gain unauthorised access to any part of the Website, server, or database.
Use automated tools (scrapers, bots, crawlers) to harvest content or data without written permission.
Upload or transmit any viruses, malware, or other malicious software.
Reproduce, duplicate, or resell any part of the Website without explicit written consent.

Work product delivered to clients (e.g., custom workflows, automation scripts) is covered under the specific terms of the relevant service agreement. Clients receive a licence to use delivered work; full IP rights remain with BRIGHTN8 unless otherwise agreed in writing.

5. User Data & Comments
When visitors leave comments on our Website, we collect the data provided in the comment form, along with the visitor’s IP address and browser user agent string to assist with spam detection.
An anonymised string derived from your email address (a hash) may be shared with the Gravatar service to verify profile picture usage. Gravatar’s privacy policy is available at https://automattic.com/privacy/. Once a comment is approved, your profile picture may be publicly visible alongside your comment.
When you submit a lead capture form, contact enquiry, or service request on our Website, we collect your name, email address, phone number, company name, and the nature of your enquiry. This data is processed to respond to your enquiry and, where relevant, to deliver the contracted service.

If you leave a comment, the comment and its associated metadata are retained indefinitely so that we can recognise and approve follow-up comments automatically, without placing them in a moderation queue.
For registered users, personal information is retained as long as the account remains active. Users can see, edit, or delete their personal information at any time (except usernames). Website administrators can also view and edit this information.
Lead enquiry data submitted via contact forms is retained for a period of up to 24 months to facilitate follow-up communications and service delivery, after which it is deleted or anonymised.

12. Payment & Refund Policy
All service fees are agreed upon in advance through a formal quote or statement of work. Unless otherwise stated:
A deposit of 50% is required before work commences.
The remaining balance is due upon project completion or as per agreed milestone schedule.
All prices are quoted in AED or USD and are exclusive of VAT where applicable.
Invoices are payable within 7 business days of issue.
Refund Policy
Due to the custom and consultative nature of our work, deposits are non-refundable once a project has commenced. Refunds for incomplete work may be considered at our sole discretion where BRIGHTN8 is unable to deliver on agreed terms. All refund requests must be submitted in writing to info@brightn8.com.

13. Disclaimers
While we strive to ensure the accuracy and reliability of all content on our Website and services we deliver, BRIGHTN8 makes no warranties, express or implied, regarding:
The uninterrupted or error-free operation of the Website or any third-party platforms integrated into your automation workflows.
The results achieved through AI automation, which may vary based on data quality, third-party API availability, and business conditions.
The accuracy or completeness of any information provided on the Website.
The Website and its content are provided on an “as is” and “as available” basis without any representation or endorsement made.

14. Limitation of Liability
To the fullest extent permitted by UAE law, BRIGHTN8 shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, data, revenue, or business opportunities — arising from your use of the Website or our services, even if we have been advised of the possibility of such damages.
Our total aggregate liability for any claim arising under or in connection with a service shall not exceed the total fees paid by the Client for that specific service in the 30 days preceding the claim.

15. Governing Law & Disputes
These Terms are governed by and construed in accordance with the laws of the United Arab Emirates. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of the UAE.
Before initiating formal proceedings, both parties agree to attempt to resolve any dispute through good-faith negotiation for a period of 30 days.

16. Changes to These Terms
BRIGHTN8 reserves the right to update these Terms and Conditions at any time. Changes will be published on this page with an updated effective date. It is your responsibility to review these Terms periodically. Continued use of the Website or services following any changes constitutes your acceptance of the updated Terms.
For significant changes, we may notify registered users via email.
